About these terms and conditions: Use of this website is acceptance of these terms and conditions. If you do not agree to these terms and conditions, please do not use this website. ​

These terms and conditions govern visitors' access to and use of the website, the facilitation and provision of user products or services and the sale of any products or services ordered via the website or app. BondiBeach.com may modify or repeal these terms and conditions without prior notice. In case of a modification or repeal, the pre-existing terms and conditions continue to apply to any donations, or promotional products provided to or ordered via the website before the change takes effect.

​Intellectual property: Creative assets, material, processes and capabilities displayed on the website are subject to copyright owned by BondiBeach.com or its content suppliers, payment partners or affiliates, and is protected by law. Brands and logos displayed on the website may be the subject of registered trade marks of BondiBeach.com or its product suppliers and protected by law.

A visitor to the website may access, display, download and print portions of the website for their own private non-commercial use and to order products via the website, subject to any additional restrictions displayed on the website. Any other use of material on the website is prohibited.

All content included on this site, including but not limited to text, graphics, logos, button icons, images, processes and software is the property of BondiBeach.com or its content suppliers and is protected by the Commonwealth of Australia Copyright Act 1968 and other international copyright laws. Digital based services and products, including any companion data and behaviours, associated learning models, algorithms, or processes are BondiBeach.com's Intellectual Property.​

BondiBeach.com does not represent or warrant that the functions within the website would be uninterrupted or error-free, that any defects would be corrected, or that the website or the server that makes the website available is free of viruses or other harmful elements.

Password security

​A visitor to the website,  and allocated a password, is responsible to prevent the password being disclosed to any third party.

Privacy​

Customer privacy is important to BondiBeach.com, and BondiBeach.com deploys encryption and other technology with the aim of protecting any payment information and the customers personal details within the BondiBeach.com database.

Access to this database within BondiBeach.com or its affiliates is restricted. BondiBeach.com does not sell, rent, trade or rent personal information. If a visitor has any questions regarding our Privacy Policy, please notify BondiBeach.com. 

BondiBeach.com will delete customer data upon two years of inactivity. A customer may have their personal and account data deleted upon request.

Donations and Purchases

Transactions undertaken via this site are facilitated by Creative Information Pty Limited ABN 94 001 627 498.

To buy products, or services, via a BondiBeach.com supplied service, Individuals or entities must be at least 18 years of age.

For physical product, i.e. promotional items, Individuals or entities, are required to specify a delivery or registered address. By placing an order, the buyer confirms they are at least 18 years of age. 

​Special offers

At any time, BondiBeach.com may terminate any special offer without advance notice.

Vouchers and Offers

Any promotional voucher or offer may only be redeemed once per user. Vouchers or offers may not be used in conjunction with any other vouchers - strict limit of one voucher or offer per order.

Prices

Prices stated are in Australian dollars, and may be per item or per offer, as stated. Prices are inclusive of GST, unless otherwise stated. All delivery charges are extra, and not included in stated prices.

Payment

A buyer may pay for an order by Visa or MasterCard or PayPal when ordering. If the credit card issuer does not authorise the transaction, or later revokes authorisation for the transaction, BondiBeach.com may cancel the order. A buyer may also facilitate an order via a Crypto Currency. Refunds of received Crypto Payments will only be made once the buyers identity and destination wallet are confirmed.

Pricing errors

If a product inadvertently appears on the website at the wrong price, BondiBeach.com may decline or cancel any orders placed at the wrong price, even if the order has been confirmed and a credit card charged. If a credit card was charged for the purchase and the order is so cancelled, BondiBeach.com will notify the buyer and issue a credit to the credit card account in the amount of the wrong price.

Product availability

All physical product is offered for sale on the basis of known stock on hand. If a product is subsequently found to be out of stock, Creative Information will refund your money.

​Delivery

BondiBeach.com endeavours to deliver product, to Australian capital city metropolitan areas within the nominated number of working days. For delivery addresses in Australian regional centres, allow at least 10 working days. Creative Information does not however guarantee any specific delivery date. 

​Product is normally delivered Monday to Friday 9.00 am to 5.00 pm and to either business premises or a residence. If the premises are unattended, product may not be left but rather the courier will leave a card and the buyer needs to arrange delivery to an attended address.

​Please note: If your shipment is returned to us as a result of incorrect address or insufficient information you will be required to pay a second freight charge or a refund of your order less initial freight cost will be completed. 

Risk

Risk of damage, loss or deterioration to product passes to the buyer on delivery.

Title

Physical product, such as merchandise or promotional items, remains BondiBeach.com's property until paid for by the buyer. Digital based services and products, including any associated learning models, algorithms, or processes remains under BondiBeach.com's Intellectual Property.

Product and service warranties

BondiBeach.com warrants that any physical product or services supplied is of good quality when delivered. BondiBeach.com warrants that such services supplied, will, where deemed reasonably and commercially possible, conform to the intent of the service description, minus any fees and charges that may be applicable.  Subject to applicable law, BondiBeach.com does not make any other warranty or representation about products or services on offer.  Beta or new products, and services as flagged, when launched may be subject to issues, bugs and intermittent service. BondiBeach.com encourages users to notify us in any such case..

Notices to visitors

BondiBeach.com may notify a visitor to the website by mobile number, email, a general notice on the website, or by other reliable method to an address previously provided to BondiBeach.com by the visitor.

​Social Media

​When clicking social media buttons such as Twitter or Facebook, data is sent to the social media site in question.

​Governing laws

​The laws in the Sate of NSW, Australia, govern the use of the website and the supply of products and services.

​Force majeure

​BondiBeach.com is excused from performing its physical or digital product supply obligations where and so long as prevented from doing so by reason of events beyond its reasonable control. Where product has been purchased, BondiBeach.com will endeavour to notify the buyer of the delay, where reasonable, and its' expected duration. If so prevented, for a longer than reasonable time, BondiBeach.com may elect to cancel the order without liability to the buyer.
